Welcome to Kids Science Labs

These Terms of Service (“Terms”) are a legally binding contract and govern your, your children’s, and/or your guests access to, and use of, the website at https://kidssciencelabs.com/ and other digital and non-digital, products, services, activities, field trips, afterschool classes, birthday parties, camps including, but not limited to Kids Science Labs Programs (“Services”) offered by Kids Science Labs, LLC, a California limited liability company.

These terms provide important information, including our limitation of liability, your waiver of any right to participate in a class action, and your agreement to resolve any disputes between you and Kids Science Labs by binding individual arbitration. By using the Services, you agree to be bound by these Terms.
It is important that you carefully read and understand these Terms. If you do not agree to these Terms, you should not use the Services. Your use of the Services will constitute your acceptance and consent to these Terms

Changes to these terms of Service

We reserve the right to change these Terms from time to time, at our sole discretion. All changes are effective immediately. You agree that your continued use of the Services following such changes constitutes your acceptance of such changes to these Terms.

Cancellation Policy

Your child(ren)’s enrollment and participation in our camp is subject to the following payment, transfer and cancellation terms:

Enrollment and Payment:

Payment is due upon enrollment, either in full or, where available, according to our Pay Over Time schedule. Customers may not participate in camp programs until all payments have been made.

If you are eligible for and have elected our Pay Over Time option, automatic payments will be processed according to the schedule displayed at the time of registration and included in your confirmation email. Should an automatic payment fail, Kids Science Labs will notify you via email, and provide you an opportunity to re-attempt your transaction and/or update your payment method. Failure to complete a scheduled payment following notification may result in cancellation of your purchase, subject to the standard terms below.

Transfers and Cancellation

You may transfer to a different session or location at any time, up until fourteen (14) days before the start of the enrolled camp session at no charge, subject to availability.

You may transfer to a different birthday party date in the future, within 12 months of the original reservation, should your child or key member of your family be sick or is unable to attend the birthday party for any legitimate reason, subject to schedule availability. However, no refunds are available on any monies paid for birthday parties, including the non-refundable deposit, once they have been charged to your account.

The following cancellation rules apply to ALL Kids Science Labs enrollments, including Early Enrollment , Pay Over Time enrollments, standard enrollment and extended care enrollments for the upcoming summer camp season.

All families, whether enrolled in lump sum payments or Pay Over Time enrollments, agree that any previous payments are non-refundable, once charged, including, but not limited to:
- Early Enrollment Camp transactions: this is recognized as the first date of purchase in the Early Enrollment timeframe.
- Pay Over Time transactions: this is recognized as the date at which your original enrollment is processed and your first payment is made.
All families, who use Pay Over Time, upon cancellation, will not be charged for any future fees after cancellation of their enrollment, from the date of cancellation. However, any Pay Over Time monies received by Kids Science Labs, prior to cancellation, are non-refundable.
Families who are unable to attend any summer camp do not receive any credits for other services at Kids Science Labs.
Families, whose travel plans for the summer, may change, are welcome to attempt to reschedule a purchased camps session, as long as the request was made at least 7 days prior to the start of camp, subject to availability, within the same calendar year summer camp.

All dates refer to the calendar year of the camp enrollment in question

For purposes of this cancellation policy, “first camp start date” refers to the first day of the earliest session in which you originally enrolled, or which you selected (for Early Enrollment purchasers), regardless of any subsequent transfers. For Early Enrollment purchasers who cancel prior to selecting week(s) of attendance, the “first camp start date” shall be calculated as the latest available camp start date in the community designated at the time of Early Enrollment.

Given the nature of our programs, Kids Science Labs incurs substantial non-recoverable costs and expenses in planning, preparing and pre-paying for camps. Therefore, no exceptions to these policies may be made for events affecting customers’ ability to attend camp (including, but not limited to: job loss, summer travel, summer school attendance, relocation, illness).

All refunds will be made to the original form of payment UNLESS refund takes place 180 or more days after initial enrollment transaction (see definition above). In these cases, the refund will be processed by check which can take up to 8 weeks to receive by the participant.

Early Enrollment (“Presale”):

During Kids Science Labs Early Enrollment period, you may have the opportunity to purchase discounted camps, birthday parties, field trips or other service session enrollments in advance for the upcoming season. This allows you to select the specific week(s) and location(s) of attendance at a later date once Kids Science Labs’ summer schedules are finalized and made public. Early Enrollments entitle the purchaser to attendance at camp sessions offered and available during the upcoming summer camp season ONLY, and apply equally to any 5-day or holiday-shortened 4-day camp session.

An additional supply and materials fee may be required at the time of your session selection should you select certain Meteor age group camp sessions, depending on the projects offered. Early Enrollment purchases may not be combined with any other discount or promotion.

Early Enrollment purchasers will be entitled to select their camp week(s) and location(s) ahead of the general public during a priority enrollment period, the dates of which will be announced at a later time and may vary by camp location. During the priority enrollment period, Early Enrollment purchasers are guaranteed their choice of week(s) and location(s), corresponding to the number of early enrollments purchased and subject to any additional fees required for specific camp sessions, such as a supply and materials fee. Following the priority enrollment period, selection of all weeks and locations is subject to availability.

No refunds or credits shall be issued for unused early enrollments, other than as expressly stated in these Terms of Purchase. Expiration of Early Enrollment purchase void where prohibited by law or limited to the minimum period required by law as applicable.

Cancellation by Kids Science Labs

If Kids Science Labs cancels a camp session for any reason within its reasonable control, you may choose between a 100% refund to the original payment method, which will be paid 120 days after such a request, or a 110% future camp credit to be redeemed for services by August 31, of the subsequent calendar year. In the event of an interrupted camp program, the amount of the refund or future camp credit will be prorated for the missed portions of the program.

Kids Science Labs offers, from time to time, our Early Enrollment sale in communities where we plan to hold camp during the upcoming summer. However, if during the upcoming summer camp season Kids Science Labs does not offer a camp location within 15 miles of the community you designate at the time of your early enrollment, we will transfer your enrollment to another convenient location at no cost or issue a full refund to your original method of payment.

Cancellations/Modifications Required by External Events Beyond Kids Science Labs’ Reasonable Control

Kids Science Labs shall not be liable to any customer for Kids Science Labs’ need to cancel, modify or postpone any of its SERVICES as a result of events that are beyond Kids Science Labs’ reasonable control (a “Force Majeure Event”). Kids Science Labs incurs substantial non-recoverable costs and expenses of its own in planning, preparing, and pre-paying amounts for camps. Accordingly, if Kids Science Labs cannot operate a camp as originally scheduled or it is interrupted due to any Force Majeure Event, customers will receive a credit for all monies paid, which must be redeemed for services by August 31st of the year after the purchase has been made . In the event of an interrupted camp program, the amount of the future camp credit will be prorated for the missed portions of the program. Cancellation, modification or postponement by Kids Science Labs for causes described in this section shall not be a violation of its obligations to any customer and will not be deemed a “failure” to provide services.

Force Majeure Events include, but are not limited to, such “acts of God” or events as actual or threats of: (i) epidemics or pandemics, or other public health issues or emergencies (such as but not limited to the current COVID-19 pandemic); (ii) severe weather events or natural disasters such as but not limited to hurricanes, earthquakes, tsunamis, tornadoes, fires, floods, volcanic activity or landslides; war (whether declared or undeclared); (iii) terrorist activities; (iv) incidents of violence, riot, sabotage or civil commotion; (v) strikes or labor disputes or lockouts; (vi) government orders, sanctions, actual or potential quarantines, or other restrictions affecting activities in or around a camp location; (vi) chemical or radioactive contamination; (vii) any other reason that makes it actually or potentially impossible or illegal for Kids Science Labs to offer camp services as originally contracted; or (viii) unavailability of camp facilities due to (i)-(vii) above.

Payment from a Bank Account

Use of a bank account as a payment method on Kids Science Labs’ website is subject to these terms and conditions (the “Terms”). Use of the Kids Science Labs website is also governed by our Terms of Service and Privacy Policy. We may update these Terms by posting updates on our website. By continuing to use your bank account as a payment method, you accept the updated Terms.

Authorization: When you pay for camp enrollments using your bank account, you authorize us to debit your bank account up to the total amount of your purchase, including applicable fees. You also authorize us to further debit or credit your bank account to correct any erroneous debit, make necessary adjustments to your payment, or to issue a refund back to your bank account.

Bank Account Eligibility and Verification: Your bank account must be able to accept debits denominated in US dollars. You authorize us to make any inquiries or obtain any information, including a credit report or other credit checks, that we determine are necessary to verify your bank account. We may suspend, refuse, or remove your ability to make a payment using your bank account without notice for any reason at any time.

Returned Payments: If your bank returns any payment using your bank account unpaid (for example, if you have insufficient funds available), we may retry the payment. Your bank may charge you an overdraft or other fees for each payment failure. Additionally, you authorize us to charge any other valid payment method we have on file for any amount that remains unpaid after any attempted charge. We may initiate a collection process or legal action to collect any money owed to us. You agree to pay all our costs for such action, including any reasonable attorneys’ fees.

Links to Third Party Sites

The Kids Science Labs WebSste may contain links to other Web Sites ('Linked Sites'). The Linked Sites, including but not limited to Customer Relationship Management (“CRM”) Web Sites, are not under the control of Kids Science Labs and Kids Science Labs is not responsible for the contents of any Linked Site, including without limitation, any link contained in a Linked Site, or any changes or updates to a Linked Site. Kids Science Labs is not responsible for webcasting or any other form of transmission received from any Linked Site. Kids Science Labs is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Kids Science Labs of the site or any association with its operators.

No Unlawful or Prohibited Use

As a condition of your use of the Kids Science Labs Web Site, you warrant to KIDS SCIENCE LABS that you will not use the Kids Science Labs Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Kids Science Labs Web Site in any manner which could damage, disable, overburden, or impair the Kids Science Labs Web Site or interfere with any other party's use and enjoyment of the Kids Science Labs Web Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Kids Science Labs Websites.

The materials in the Kids Science Labs Web Sites are provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permissible under applicable law, K1 Speed disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement. Kids Science Labs does not warrant that the functions contained in the Web Sites will be uninterrupted, error-free, accurate, reliable, of any quality, that defects will be corrected, or that the Web Sites or the server that makes them available are free of viruses or other harmful components, nor is it warranted either implicitly or expressly that any content is safe in any manner for download. Kids Science Labs does not make any representations regarding the use or the results of the use of the materials in the Web Sites in terms of their correctness, accuracy, reliability, or otherwise. Submissions Made by Consumers

Kids Science Labs is not responsible for any material posted on its Forums, including, but not limited to social media sites such as Facebook, Instagram, Twitter, etc. Visitors shall not submit or otherwise publish through such Forums any content which:

a. libels, defames or invades privacy, or is obscene, pornographic, abusive, or threatening;

b. infringes any intellectual property or other right of any entity or person, including, but not limited to violating anyone’s copyrights or trademarks;

c. violates any law;

d. advocates illegal activity;

e. advertises or otherwise solicits funds or is a solicitation for goods or services;

f. impersonates or misrepresents your association with any person or entity; or

g. conceals or misrepresents the origin thereof.

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE KIDS SCIENCE LABS WEB SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. KIDS SCIENCE LABS AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE KIDS SCIENCE LABS WEB SITE AT ANY TIME. Camp, Class and Birthday Party Restrictions and Code of Conduct

All guests at Kids Science Labs are required to sign our liability waiver, prior to participation, whether limited or full, at any of our summer camps, day camps, birthday parties, field trips, STEM Labs, afterschool classes, or any other service or product provided, whether on-site at our facilities, or off-site by our staff. By way of your participation, you agree to our Terms of Service, and to comply with our code of conduct https://kslchicago.box.com/v/codeofconduct .. Any guest may be removed for any violation of our code of conduct or for exhibited any behavior that may reasonably endanger a child, our staff, our facilities, programs, or brand.

Kids Science Labs reserves the right, in its sole discretion, to disallow and/or reject certain birthday party requests, when it deems that they may reasonable create a risk to its staff, guests, facilities, or business. Such restrictions may include and are not limited to:

Use of food or certain third-party products that may contain peanuts, tree nuts, or other items that any guest explicitly or implicitly suggests may result in bodily harm or other major health concern due to a child, and/or guest who has a severe food allergy.
Use of unauthorized photographers, videographers or other third-parties event specialists who may attempt to have unapproved uses of our facilities or programs
Use of Clowns, Facepainters, and/or Third-party guests
Any use that would violate Kids Science Labs Terms of Service, Conduct Policy, or Privacy Policy, included by not limited to behaviors that may create risk to our staff, facilities, or programs.

Termination and/or Restriction

Kids Science Labs reserves the right, in its sole discretion, to terminate your access to the Kids Science Labs Website and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the State of ILLINOIS, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Cook County, ILLINOIS, U.S.A. in all disputes arising out of or relating to the use of the Kids Science Labs Web Site. Use of the Kids Science Labs Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Kids Science Labs as a result of this agreement or use of the Kids Science Labs Web Site. Kids Science Labs' performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Kids Science Labs' right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Kids Science Labs Web Site or information provided to or gathered by Kids Science Labs with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Kids Science Labs with respect to the Kids Science Labs Web Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Kids Science Labs with respect to the Kids Science Labs Web Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent an d subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English
